This Privacy Policy is maintained by MYO MUNCHEE (OPERATIONS) PTY LTD (ACN 629 971 115 (“Myo Munchee”) (“we”, “us” and “our”) and relates to the collection and use of personal information you may supply to us or we may collect from you. We also collect information about your use of our services such as access logs, as well as information from third parties.
We recognise the importance of protecting the privacy of your information, in particular information that is capable of identifying an individual ("personal information"). This Privacy Policy governs the manner in which your personal information will be dealt with including but not limited to collection, access, storage and use of personal information which we obtain as part of our business operation. By accessing any Myo Munchee website or platform, including the Munchee U Learning Management System, or any other system or databases maintained by us or otherwise transacting with us, you agree to and acknowledge the content of this Privacy Policy. This Privacy Policy is in addition to any other agreement or terms and conditions applicable to our dealings with you.
Personal Information
- Personal information about you is collected only when knowingly and voluntarily submitted and when reasonably required by us to perform one or more of our functions or activities.
- It is our intention that this Privacy Policy will protect your personal information from being dealt with in any way that is inconsistent with applicable privacy laws in Australia including the Australian Privacy Principles (“APPs”). The type of personal information that we may collect and hold includes:
- When you create an account, you provide us with at least your phone number and email address, as well as some basic details necessary, such as your name, date of birth, location, and Practitioner ID, if applicable.
- When you complete your account, you consent to us using it for the purposes identified and as laid out in this Privacy Policy.
- When you participate in surveys, focus groups or market studies, you give us your insights into our products and services, responses to our questions and testimonials.
- When you choose to participate in our promotions or events, we collect the information that you use to register or enter.
- If you contact us (e.g., through our customer care team, via our AI Chat Bot function or on social media), we collect the information you give us during the interaction.
- We also process your chats with other users as well as the content you publish to operate and secure the services, and to keep our community safe.
- Where it is reasonable and practical to do so we will only collect personal information about you from you. You have no obligation to provide any information requested by us however if you choose to withhold personal information from us it may prevent us from being able to provide you with the services that you have requested.
- We will take reasonable steps to ensure that your personal information is accurate, complete and up-to-date as soon as practicable after receiving your notification of any error or inaccuracy.
Provision of Personal Information about another person
- If you provide us with someone else’s personal information, you should only do so if you have that person’s authority or consent to provide us with their personal information. You should also take reasonable steps to inform them of the existence of and the matters set out in this Privacy Policy.
Use of Information
- Personal information collected from you is used for the following purposes:
- Identification purposes;
- to allow you to register and access an account;
- to offer you our products, services and features or to contact you regarding our products or services;
- personalise the website and the content we deliver to you;
- to manage your account with us;
- to liaise with others in our organisation to manage or administer aspects of the products and services that we provide to you;

- Personal information is held in paper archives, by electronic or computer data base and remotely in cloud based storage systems.

- With our service providers and partners: we may engage third parties to provide you with products or services on our behalf. In those circumstances, we may disclose your personal information to those third parties in order to meet your request for products or services.
- For corporate transactions: we may transfer your information if we are involved, whether in whole or in part, in a merger, sale, acquisition, divestiture, restructuring, reorganization, dissolution, bankruptcy or other change of ownership or control.
- With law enforcement / when required by law: we may also disclose your personal information where it is required or authorised by or under an Australian law or a court/tribunal order or where a permitted general situation exists under the APPs. Where disclosure is necessary for an enforcement related activity of an enforcement agency, we will provide written notification of that disclosure as is required by the APPs.
- To enforce legal rights: we may also share information: (i) if disclosure would mitigate our liability in an actual or threatened lawsuit; (ii) as necessary to protect our legal rights and legal rights of our members, business partners or other interested parties; (iii) to enforce our agreements with you; and (iv) to investigate, prevent, or take other action regarding illegal activity, suspected fraud or other wrongdoing.
- With consent at your request: we may ask for your consent to share your information with third parties. In any such case, we will make it clear why we want to share the information.
- As part of provision of the services to you we may store your personal information using online software. The personal information that you provide to us may be transferred to the servers of our software providers as a function of transmission across the internet. By providing your personal information you are consenting to that personal information being transferred to and stored on the servers as set out in this Policy. However, as the third parties who host our servers do not control, and are not permitted to access or use your personal information (except for the limited purpose of storing the information), we do not “disclose” personal information to those server hosts, whether or not they are located overseas.
Security
- We strive to ensure the security, integrity and privacy of personal information collected and held by us, and we review and update our security measures in light of current technologies. Unfortunately, we cannot guarantee that our data storage measures are totally secure.
- However, we will endeavour to take all reasonable steps to protect the personal information we collect from you from misuse, interference, loss and unauthorised access, modification or disclosure.
- Where the personal information is no longer required for the purpose for which it was collected (or a permitted secondary purpose) we will take reasonable steps to destroy or de-identify the information.
Using Allied Health or Medical Practitioner Identifiers
- In certain circumstances we may be required to collect Allied Health or Medical Practitioner identifiers from or relating to you, such as your Practitioner ID or Registration number or other identifier. We will not use or disclose this information unless you have provided your consent to the disclosure or otherwise where we are required or authorised to do so by law.
IP Addresses
- If information is gathered by our website/Munchee U platform including via the AI Chat Bot function or online database, our web servers may gather your IP address to assist with the diagnosis of problems or support issues with our services. This information is gathered in aggregate only and cannot be traced to an individual user.
- Our App and website may contain links to third parties’ websites, including sites maintained by related entities. Those other websites are not subject to this Privacy Policy. You should familiarise yourself and ensure you are comfortable with any particular privacy policies governing the use of those websites prior to such use.
Cookies and Applets
- We may use cookies to provide you with a better experience when using our website/ Munchee U platform or contacting us via the AI Chat Bot function. These cookies allow us to increase your security by storing your session ID and are a way of monitoring single user access. This aggregate, non-personal information is collated and provided to us to assist in analysing the usage of the site.
Access to Information
- Depending on which services you are attempting to access, you may be able interact with us anonymously or using a pseudonym. However, this will mean that there are some products and services that you will not be able to enjoy. These include online orders/purchases.
- We will endeavour to take all reasonable steps to keep information about you accurate and up to date. If, at any time, you discover that information held about you is incorrect, you may contact us to have the information corrected. Further you may request access to any of your personal information we hold except if the provision of the information is contrary to any applicable privacy law.
- In addition, our employees and the contractors who provide services related to our information systems are obliged to respect the confidentiality of any personal information held by us.
- If you wish to make a complaint regarding any aspect of the collection, access to, use or storage of personal information by us, please make your complaint in writing to the address below. We will consider your complaint promptly and contact you to seek to resolve the matter. If we have not responded to you within a reasonable time, you are entitled under privacy legislation to make a complaint to the Office of the Australian Information Commissioner.

- accepting a clickthrough agreement containing or referencing this Agreement; or
- accessing or otherwise using the Platform.
4. Your Account
- The Myo Munchee website; and
- The Munchee U website.
7. Payment Terms
- retain all fees paid by credit card or remitted to us via a third party merchant or finance provider;
- investigate, suspend and/or terminate your account without a refund of any Fees if you have violated this Agreement, misused the Platform or acted in a way that Myo Munchee regards as inappropriate or unlawful, including actions or communications that occur on or off the Platform.
- comply with the Agreement;
- comply with all applicable laws, including without limitation, privacy laws, intellectual property laws, and regulatory requirements;.
- treat other users of the Platform in a courteous and respectful manner;
- be respectful when communicating with any of our customer care representatives or other employees of Myo Munchee; and
- maintain a strong password and take reasonable measures to protect the security of your login information.
- misrepresent your identity, age, current or previous positions, qualifications as a health, allied health or medical practitioner, or affiliations with a person or entity;
- use the Platform in a way to interfere with, disrupt or negatively affect the Website;
- use the Platform for any harmful, illegal, or nefarious purpose;be respectful when communicating with any of our customer care representatives or other employees of Myo Munchee; and
- post inappropriate or offensive language and/or images while using the Platform (as determined by Myo Munchee);
- use another user’s account;
- provide your logon details and passwords for the Platform to any other person; and
- create a new account after we suspend or terminate your account, unless you receive Myo Munchee’s’s express permission.
- that the Platform is of merchantable quality, suitable for your use, or is fit for any other purpose or use;
- that operation of the Platform will be-uninterrupted or that the Platform is error-free;
- regarding the results of any use of the whole or any part of the Platform; or
- as to the accuracy, reliability or content of any data, information, service or goods obtained through any use of the whole or any part of the Platform.
- fraud or wilful misconduct; or
- liability for infringement of Intellectual Property Rights.
- breach by the Indemnifier of the Agreement;
- (any claims arising out of or in any way related to an injury to or death of any person or loss of or damage to any tangible property arising out of or in any way relating to this Agreement and caused by the Indemnifier’s act or omissions; and
- any claim by a third party arising out of or in any way related to the Indemnifier’s wilful, negligent, or unlawful act or omission,
- not to decompile, copy, disassemble, reverse engineer or otherwise attempt to derive or use the Source Code from the Platform or any part of it;
- not to copy or engage any third party for the purposes of copying the functional operation of the Platform, including without limitation the “look and feel” of the user interface, the logical sequence of operations and commands of the Platform and its on screen graphic style, colours, and content;
- not to sell, rent, lease, licence, display, or otherwise transfer any part of the Platform to, or permit the use of any part of the Platform by, any third party;
- to preserve the confidential nature of the Confidential Information (including Intellectual Property Rights contained within the Platform), and to use reasonable care to prevent the unauthorised use, copying, publication or dissemination of any part of the Platform and/or Myo Munchee’s Confidential Information;
- not to alter, enhance, adapt, develop or modify any part of the Platform or attempt to do any of those things or procure a third party to do or attempt to do any of those things;
- not to knowingly disclose or grant access to the Platform or any part of it to any third party who may, or has the capacity to contravene sub clauses (1) to (3) above; and
- not to permit or allow any third party to do anything which, if committed by you, would be a breach of any one or more of the sub clauses (1) to (6) above.
- power, data or communication outages;
- acts of God or the public enemy, national emergencies, radioactive contamination, insurrection, riot, hostile or warlike action or sabotage;
- a transportation embargo;
- industrial action (including a picket); and
- any legislation or regulation and any action or inaction of any government or government agency.
- as soon as reasonably practicable after the Force Majeure event arises, the party must notify the other party of the extent to which the notifying party is unable to perform its obligations, the date of commencement of non-performance and the means proposed to be adopted to remedy or abate; and
- that party’s obligation to perform will be excused for the duration and to the extent of the delay arising directly out of the Force Majeure event of which notice is given under this clause.
